issue with instructor feedback in essay questions: alignment characters

If I use an align environment in my feedback to an essay question, the amphersand characters are translated to their HTML code equivalents, and then MathJax is unable to process the block of TeX code. 

I only see this when I have written feedback, saved it, and go to the problem from the student's perspective. I don't see this if the student uses alignment characters in their answer. And I don't see this while still composing the feedback and using the preview button.

In case it matters, all my examples were in display mode; I didn't try inline.

Is this easily fixed? Is it just a problem with the stage where feedback is written to the database? Or is it a problem with how that feedback is read and loaded on the student's page?
